County commissioners adopt psilocybin restrictions

Clatsop County commissioners on Nov. 13 approved time, place and manner regulations on psilocybin in unincorporated portions of the county.
Psilocybin is a psychedelic drug derived from fungi. It remains a Schedule 1 controlled substance on the federal level, but in 2020, Oregon voters approved a first-of-its-kind measure authorizing the Oregon Health Authority to license and regulate the manufacturing, testing and distribution of the substance.
The county’s new regulations come as a temporary two-year moratorium on those activities is set to expire at the end of the year.
The regulations place restrictions and siting parameters on three main activities: farming, manufacturing and service centers.
Per the ordinance, farming and manufacturing must take place in enclosed structures and meet all applicable zoning requirements. Service center operators must maintain necessary state licenses and cannot run psilocybin businesses out of their homes. All three activities must maintain a minimum 1,000-foot setback from the property lines of schools.
The ordinance also sets operating hours from 6 a.m. to 10 p.m. for manufacturing facilities and service centers.
In the November election, voters in Warrenton and Seaside prohibited psilocybin-related businesses within city limits.
